Your contract with Aquamarine Divers Co.,Ltd. (hereafter referred to as Aquamarine Divers) is subject to the terms and conditions below.

1. Booking

Booking will take effect once Aquamarine Divers has received a deposit or payment in full, and Aquamarine Divers has issued the Booking Confirmation Letter. This will constitute a contractual binding obligation between you and Aquamarine Divers.

Aquamarine Divers reserves the right to accept or refuse a booking without necessarily giving a reason. Completed booking form should arrive at least 2 weeks prior to date of departure.


2. Health & Fitness Requirements

Any physical or mental disability requiring special attention must be disclosed at the time of booking. Aquamarine Divers reserves the right to exclude participants who are physically or mentally ill. All of our cruises require a high level of fitness from the participants.


3. Pricing Policy

The prices taken as referenced are the retail price mentioned on Aquamarine Divers official web sites: www.atitara.com, www.philkade.com and www.aquamarinedivecenter.com. Any price update shall not affect bookings already made and accepted by Aquamarine Divers.


4. Travel Documents

It is your own responsibility to hold travel documents, which must be valid for at least 6 months at the time of visa application.

For cruises to Burma, Multiple Entry Visa to Thailand is required for citizens from certain countries. Please check with the Thai Embassy/consulate in your home country.


5. Payment Terms and Conditions

a. Individual/Group Bookings :

  • 366 days & more before departure of the cruise: 15% deposit is required upon booking.
  • Between 365 & 61 days before departure of the cruise: 30% of the price must be paid.
  • 60 days before departure of the cruise, 70% balance must be paid.

b. Whole Boat Charter :

  • 366 days & more before departure of the cruise: 15% deposit is required upon booking.
  • Between 365 & 121 days before departure of the cruise: 30% of the price must be paid.
  • 120 days before departure of the cruise, 70% balance must be paid.

Any incomplete or late payment will be considered as a cancellation by you and will be subject to cancellation charge as per clause 6.


6. Payment Method

Payment can be made in part (minimum 50% to confirm the booking) or in full by credit card (Visa/MasterCard) or by TT/bank transfer payable to Aquamarine Divers bank account. Please contact us for account details.

In case of bank transfer, you will be asked to email or fax the bank transfer receipt to Aquamarine Divers as confirmation. You will be responsible for payment of all bank charges including those incurred by Aquamarine Divers due to cancellation, refunding or similar (these are generally covered by the relevant fees).

For payment by credit card, to ensure ultimate security, Aquamarine Divers will issue an email containing a secure link upon request. This link will already contain Aquamarine Divers details and provides a direct link for credit card payments to Aquamarine Divers account. There is a 3% charge for all credit card transactions.


7. Alteration / Cancellation Policies

Alteration By You

All alteration requests must be received in writing either by e-mail or by facsimile. Aquamarine will endeavour to accommodate the amendment requested but cannot be held liable if such amendments cannot be accommodated and the initial booking shall stay in force.

Major alterations, which interfere with Aquamarine Divers’ booking schedules, may be treated as cancellations and re-bookings and the relevant charges may apply.

Transfer of booking to another person may be accepted, subject to an administration fee of US$50 per person.

Cancellation By You

Cancellation request must be received in writing either by e-mail or by facsimile. The cancellation date will be the date of reception of the cancellation document by Aquamarine Divers (Thailand is GMT +7). All bank transfer charges are your responsibility. The cancellation charges depend on when Aquamarine Divers is informed prior to departure of the cruise as follows:

a. Individual/Group Bookings :

  • 366 days & more before departure of the cruise: 15% of the trip price will be charged.
  • Between 365 & 61 days before departure of the cruise: 30% of the trip price will be charged.
  • 60 days before departure of the cruise, 100% of the trip price will be charged.

b. Whole Boat Charter :

  • 366 days & more before departure of the cruise: 15% of the trip price will be charged.
  • Between 365 & 121 days before departure of the cruise: 30% of the trip price will be charged.
  • 120 days before departure of the cruise, 100% of the trip price will be charged.

In case you DO NOT ARRIVE, for any reason, and no cancellation has been made - the total value of the booking is forfeit. The fare is not refundable, wholly, or in part, if you wish to join or leave the cruise at any time except on the specified start and finish dates and times.

Alteration and Cancellation By Aquamarine Divers

Aquamarine Divers reserves the right to change schedules & itineraries as and when they deem it necessary. As far as possible they will ensure the minimum disruption to the customer holiday. Main reasons would include weather conditions or regulatory restriction on the proposed itinerary.

Aquamarine Divers reserves the absolute right to cancel or change a confirmed cruise for the following reasons:

  • as a result of “force majeure”,
  • If 30 days or more before departure there are insufficient bookings for a cruise to be viable. In this case Aquamarine Divers will inform you no later then 30 days before cruise departure date

In the unlikely event that the diving cruise has to be changed and/or cancelled Aquamarine Divers will endeavour to accommodate the customer in a similar or higher standard diving package with travelling times as close to the original departure times as possible. In case the cruise cannot be either maintained or replaced, Aquamarine Divers will refund the full amount paid. Aquamarine Divers shall not be liable for any penalty or compensation to you. It is strongly recommended that you have a cancellation insurance.


8. Liability

Aquamarine Divers is a live-aboard diving organisation. The nature of the cruises means that, in some places, and under some circumstances, passengers may face some physical discomfort and even danger. This being the case, it is expected that the customer understands and accepts the risks involved which is part of the spirit of adventure. Naturally, the management and staff of Aquamarine Divers undertake to provide every possible safety precaution and to take all due care in the course of the cruises and associated activities, but ultimately all responsibility for illness, accident, injury or death, or any property damage or loss, lies with the customer.

It is recommended that the customer takes out comprehensive travel insurance, including cancellation cover, at the time of confirming the booking. As there is an inherent risk in the activities offered by Aquamarine Divers, it is strongly recommended the customer has holiday insurance covering the activities and sports they intend to undertake.

For SCUBA diving Aquamarine Divers suggests either a DAN or PADI insurance policy to ensure that diving is covered.


9. Disclaimers

If the cruise and/or associated activity, is interrupted due to the “force majeure” e.g. outbreak of war, civil uprising, acts of terrorism, natural catastrophes (acts of god) , Aquamarine Divers is entitled to terminate the cruise and/or associated activity. In such extreme event Aquamarine Divers will assist where possible. However, any additional expenses will be incurred by the customer. (e.g. sea and land transfers, additional food, accommodation,…).

Marine vessels contain many pieces of equipment & machinery, many of which are complex and/or delicate, which have to function in extremely harsh conditions of humidity, saltwater, temperature and other climatic and operational extremes. Although the vessel is extremely well maintained, equipment breakdown can still occur. As long as the quality of the cruise is not unduly affected by a case of equipment breakdown, such a breakdown in itself is not grounds for a refund, in whole or in part.

The information provided by Aquamarine Divers about the vessels, vehicles, other modes of transport, dive sites, itineraries, schedules, crew, transfers, arrivals, departures and all other aspects is correct to the best of our knowledge. Aquamarine Divers reserves the right to change any of the above, without prior notice, as circumstances dictate.
